Health Warnings/Messages Features
Health warnings are required to cover 60% of the front of the package and 65% of the back of the package. The warning includes the messages “Tobacco KILLS” and “Prohibited to anyone under 18 years of age.”
Decree No. 0284 contains eight warning messages to appear also on the front and back of tobacco product packaging. These warnings must be illustrated by one or several images. Every two years, the party responsible for the tobacco control program will specify which two messages and images are to appear on packages. An Executive Order prescribing the health warnings has not yet been issued.
The law meets FCTC Art. 11 and aligns with the FCTC Art. 11 Guidelines with respect to size, location, and rotation of health warnings on packages on smoked tobacco products.
It is unclear whether the law requires health warnings on packages of smokeless tobacco products. Law No. 006/2013 of August 21, 2013 requires that packs of “cigarettes and other tobacco derivative products made available to the public” must display the warnings “Tobacco KILLS” and “Prohibited to anyone under 18 years of age.” However, Decree No. 0284 discusses these warning messages only in the context of packages of cigarettes and cigars.
To meet FCTC Art. 11, the law should explicitly require health warnings on all packages of smokeless tobacco products. The law should also provide health warnings that are specific to smokeless tobacco products
