Tobacco Product
“Tobacco products” means tobacco in any form intended for smoking, snuffing, chewing or sucking and includes cigarettes, cigars, cigarillos, pipe tobacco and narghile tobacco.
The definition of “tobacco products” contained in the law aligns with the definition provided in FCTC Art. 1(f).
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
Outside Packaging and Labeling
Neither the law nor the order on health warnings contains a definition of "outside packaging and labeling." The law requires health warnings on smoking products, including tobacco for a pipe or waterpipe, in a "packet or other package." In the order establishing the warnings, the term "outer packaging" is described as that of "a retail tobacco product containing a number of packets."
To aid in interpretation, implementation, and enforcement of the law, the term "package" or "packet" should be defined. To align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the law should provide a definition of "outside packaging and labeling" in accordance with the definition contained in FCTC Art. 11.
