Sales Restrictions
Sale of single cigarettes/sticks
Although the law prohibits the sale of cigarettes in packets that contain fewer than 20 sticks, the law does not affirmatively prohibit retailers from selling single cigarette sticks. Therefore, the law is interpreted as allowing the sale of single cigarettes.
To align with FCTC Art. 16, the law should affirmatively prohibit the sale of single cigarettes as this increases the affordability of cigarettes to minors.
Sale of tobacco products via vending machines
The law prohibits vending machine sales of tobacco products.
The law aligns with FCTC Art. 13, the FCTC Art. 13 Guidelines, and FCTC Art. 16 with respect to vending machine sales.
Sale of tobacco products via the internet
The law prohibits the sale of tobacco products through the internet.
The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines with respect to internet sales of tobacco products.
Sale of smokeless tobacco products
The law prohibits the sale of tobacco products intended for oral or nasal use.
Sale of waterpipe tobacco products
The law does not specifically prohibit the sale of waterpipe tobacco; therefore, the law is interpreted as permitting the sale of waterpipe tobacco.
Location-based Sales Restrictions
Schools/educational facilities
The law prohibits the sale of tobacco products in primary schools, secondary schools, institutions of higher learning, and vocational training centers.
Playgrounds
The law prohibits the sale of tobacco products in places intended for minors under the age of 18, which is interpreted to prohibit sale on playgrounds.
Stadiums/arenas
The law prohibits the sale of tobacco products in athletic facilities, which is interpreted to prohibit the sale of tobacco products in stadiums/arenas.
Healthcare facilities
The law prohibits the sale of tobacco products in establishments where healthcare is provided, including hospitals, clinics, health centers, doctors’ consulting offices, emergency facilities, laboratories, pharmacies, and places where non-prescription medications are dispensed.
Cultural facilities
The law does not prohibit or restrict the sale of tobacco products in cultural facilities; therefore, the law is interpreted as permitting the sale of tobacco products in cultural facilities.
Places intended for minors under the age of 18
The law prohibits the sale of tobacco products in places intended for minors under the age of 18, such as nurseries, daycare centers and other childcare institutions, infant and youth homes, leisure time centers, holiday camps and communities and similar institutions.
Staff cafeterias and eating places
The law prohibits the sale of tobacco products in cafeterias and eating places in public and private institutions intended exclusively for the respective personnel.
Homes for elderly or disabled persons, rehabilitation facilities, and facilities for substance abuse treatment
The law prohibits the sale of tobacco products in old age homes, homes for the handicapped, daytime centers, community centers, enclosed workshops, rehabilitation facilities and units for the accommodation and support of addicts and alcoholics.
Casinos
The law prohibits the sale of tobacco products in casinos.
Public swimming pools
The law prohibits the sale of tobacco products at public swimming pools.
Arcades, pool halls, bowling alleys and cybercafés
The law prohibits the sale of tobacco products at establishments where amusement machines and video games are operated, where billiards and bowling take place and in cybercafés.
Retail Package Size Restrictions
Minimum number of cigarette sticks per unit package
The law prohibits the sale of cigarettes in packages of fewer than 20 sticks.
The law aligns with FCTC Art. 16 with respect to the sale of small packets of cigarettes.
Minimum weight of smokeless tobacco per unit package
The law prohibits the sale of smokeless tobacco. Therefore, this requirement is not applicable.
Retail Licensing Requirements
Specific retail license or equivalent approval required to sell tobacco products
The law does not require a specific retail license or equivalent approval to sell tobacco products.
To align with FCTC Art. 15, the law should require retailers to obtain a license or equivalent approval to sell tobacco products.
