Heated Tobacco Product
“Heated product” means any product with or without tobacco, either rolled up or enclosed in paper or other material used for smoking via heating process.
The definition of “heated product” contained in the regulations includes heated tobacco products.
For the purpose of this review, we will be using the term “HTP” when referring to a “heated tobacco product.”
Tobacco product
“Tobacco product” means processed tobacco or any product that contains tobacco which is designed for human consumption.
The definition of “tobacco product” is important because, for purposes of the Act, it encompasses HTPs. Therefore, the prohibitions and restrictions on tobacco products apply to heated tobacco products.
Smoking
“Smoking” means inhaling and expelling the smoke or vapour, of any tobacco product or substitute tobacco product, and includes the holding of or control over any tobacco product or substitute tobacco product which is ignited, heated or vaporized or used in any other methods.
The definition of “smoking” is important because it includes the use of heated tobacco products (which are covered by the definition of “tobacco product”).
Specialized store
“Specialized store” means a fixed place of business or premise that is licensed by the authority solely to sell tobacco product, smoking substance or substitute tobacco product.
The definition of “specialized store” is significant because it is an exemption to the point of sale product display prohibition.
