Penalties
Manufacturer
(e.g., seizure of the product, publication of the violation/violator)
The law prescribes that fines range from either 500 Rufiyaa or 10 times the total amount of the product (to include price tax and other fees) for a first-time offense (whichever is greater), to an additional 5,000, 10,000 and 20,000 Rufiyaa for second, third and fourth offenses, respectively. The fine is capped at 100,000 Rufiyaa. If fines are unpaid, the matter can be referred to court.
Temporary suspensions, terminations, or withholding aspects of a license to trade tobacco are possible in addition to prescribed fines.
The law also describes that items used to violate the Regulation (this may be labeling equipment or tobacco products themselves) can be seized and destroyed.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines by imposing require warnings on unit and outside packaging and labeling and impose appropriate penalties on manufacturers, importers, wholesalers, and retailers who violate the law.
