Analysis

Once the provision banning characteristic flavorings in cigarette and roll-your-own tobacco is in effect, the Directorate will be responsible for supervising compliance. Violations will be punishable by a fine and/or product confiscation and seizure.

Once in effect, the law will align with FCTC Art. 9 and the FCTC Arts. 9 & 10 Partial Guidelines in that it will impose sanctions for content regulation violations.

Analysis

The Directorate supervises compliance with provisions related to disclosure requirements. Violations are punishable by a fine. However, the amount of the fine is not specified in the Act or Regulations.

In addition, tobacco products, tobacco surrogates, and tobacco devices imported in violation of the Act or Regulations can be seized and destroyed by the customs authorities.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that the law imposes sanctions for disclosure violations.
