Decision No. 272/2010 delegates authority to municipalities and the General Directorate for Health Affairs and Sanitation Control to grant permission to establish smoking areas in enclosed public places, subject to specifications. As such, municipal staff and the General Directorate for Health Affairs and Sanitation Control are responsible for enforcing bans or restrictions on smoking in enclosed public places. The law does not specify inspection authority or protocols and, therefore, it is unclear whether there is a duty to enforce.

To more fully align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should clearly designate enforcement authorities, impose a duty to enforce, and clearly state inspection duties.
