Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
Decision No. 272/2010, Art. 2, prohibits smoking in enclosed public places, which are workplaces for some people. However, Arts. 4 and 5 permit designated smoking rooms except in "places of worship, educational institutions, government departments, health facilities and sports settings." Designated smoking rooms must meet specified standards and be approved by the relevant entity of the municipality where the place is located. Because designated smoking rooms are allowed in some workplaces, the regulatory status "Smoking is Restricted" is given.
Decree No. 268/2008 on occupational safety and health states that "the workplace must be supportive to general health by working toward . . . prohibition of smoking in the workplace." Because this provision is phrased as "working toward", it is interpreted as aspirational rather than obligatory.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor workplaces. In addition, the law should contain a definition of “workplace” that aligns with the definition provided in the FCTC Art. 8 Guidelines.
All indoor public places
Decision No. 272/2010, Art. 2, prohibits smoking in enclosed public places. However, Arts. 4 and 5 permit designated smoking rooms except in "places of worship, educational institutions, government departments, health facilities and sports settings." Designated smoking rooms must meet specified standards and be approved by the relevant entity of the municipality where the place is located. Because designated smoking rooms are allowed in some public places, the regulatory status "Smoking is Restricted" is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor public places.
All public transport
Decision 272/2010, Art. 2, prohibits smoking in public transport. Although Art. 4 permits smoking in designated smoking rooms that meet specific standards, it is not possible to meet these standards in public transport. Therefore, the law is interpreted as requiring that all public transport be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking on public transport.
Government facilities
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, government facilities must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in government facilities.
Private offices
Decision No. 272/2010 prohibits smoking in enclosed public places, which are workplaces for some people. However, designated smoking rooms are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." These designated smoking rooms must meet certain specifications (contained in Art. 4), including not being used for purposes other than smoking. Therefore, to the extent a private office can meet these requirements, smoking is permitted in designated smoking rooms within private offices.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including private offices.
Hospitals
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings."
Therefore, hospitals must be smoke free. The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in hospitals.
Residential healthcare facilities - public areas
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, residential healthcare facilities, including their public areas, must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in public areas of residential healthcare facilities.
Non-residential healthcare facilities
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, non-residential healthcare facilities must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in non-residential healthcare facilities.
Childcare facilities/preschools
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings." "Educational facilities" is interpreted to include childcare facilities and preschools, and, therefore, these facilities must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in childcare facilities and preschools.
Primary and secondary schools
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, primary and secondary schools must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in primary and secondary schools.
Universities/vocational facilities
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, universities and vocational facilities must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in universities and vocational facilities.
Shops
Decision No. 272/2010 prohibits smoking in enclosed public places. However, designated smoking rooms that meet specified standards are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." Designated smoking rooms are allowed in shops and, therefore, the regulatory status "Smoking is Restricted" is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including shops.
Cultural facilities
Decision No. 272/2010 prohibits smoking in enclosed public places. However, designated smoking rooms that meet specified standards are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." Designated smoking rooms are allowed in cultural facilities and, therefore, the regulatory status "Smoking is Restricted" is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including cultural facilities.
Indoor stadium/arenas
Decision No. 272/2010, Art. 2, prohibits smoking in enclosed public places. However, designated smoking rooms that meet specified standards are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." Designated smoking rooms are allowed in indoor stadiums and arenas and, therefore, the regulatory status "Smoking is Restricted" is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including indoor stadiums and arenas.
Restaurants
Decision No. 272/2010, Art. 2, prohibits smoking in enclosed public places. However, designated smoking rooms that meet specified standards are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, designated smoking rooms are allowed in restaurants. Generally, designated smoking rooms must be at least 20 square meters. However, if a restaurant is more than 100 square meters, the designated smoking area may not exceed 50% of the restaurant area (50 square meters). Other specifications for designated smoking rooms must be met.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including restaurants.
Bars/pubs/nightclubs
Decision No. 272/2010, Art. 2, prohibits smoking in enclosed public places. However, designated smoking rooms that meet specified standards are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, designated smoking rooms are allowed in bars, pubs and nightclubs.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including bars, pubs and nightclubs.
Casinos
Casinos are not permitted in Oman.
Hotels/lodging - public areas
Decision No. 272/2010, Art. 2, prohibits smoking in enclosed public places. However, designated smoking rooms that meet specified standards are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, designated smoking rooms are allowed in public areas of hotels and lodging.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including public areas of hotels and lodging.
Hotels/lodgings - guest rooms
Decision No. 272/2010, Art. 2, prohibits smoking in enclosed public places. However, designated smoking rooms that meet specified standards are permitted except in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, designated smoking rooms are allowed in hotels and lodging, and guest rooms may be designated as smoking rooms.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all enclosed public places and workplaces, including guest rooms of hotels and lodging.
Prisons/detention facilities - public areas
Decision No. 272/2010 prohibits smoking in enclosed public places, although designated smoking rooms that meet specified standards are permitted in certain enclosed public places. However, under Art. 5, no designated smoking rooms are allowed in "places of worship, educational institutions, government departments, health facilities and sports settings." Therefore, government facilities must be smoke free. If prisons fall within the category of "government departments," they must be smoke free; however, if they are not considered "government departments," designated smoking rooms may be allowed. Because it is unclear if prisons are "government departments," the regulatory status "Uncertain" is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should make clear that smoking is prohibited in all enclosed public places and workplaces, including prisons and detention facilities.
Trains, buses and other shared ground transportation other than taxis
Decision No. 272/2010 prohibits smoking in all means of public transport. Although Art. 4 permits smoking in designated smoking rooms that meet specific standards, it is not possible to meet these standards in public transportation. Therefore, all public transport, including trains, buses, and other shared ground transportation, must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking on trains, buses, and other shared ground transportation.
Taxis (for-hire vehicle)
Decision No. 272/2010 prohibits smoking in all means of public transport. Although Art. 4 permits smoking in designated smoking rooms that meet specific standards, it is not possible to meet these standards in public transportation. Therefore, all public transport, including taxis, must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in taxis.
Commercial aircraft
Decision No. 272/2010 prohibits smoking in all means of public transport. Although Art. 4 permits smoking in designated smoking rooms that meet specific standards, it is not possible to meet these standards in public transportation. Therefore, all public transport, including commercial aircraft, must be smoke free.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in commercial aircraft.
Commercial watercraft

Therefore, all public transport, including commercial watercraft, must be smoke free.

Public transport facilities (waiting areas for mass transit)
Decision No. 272/2010 prohibits smoking in enclosed public places. Therefore, designated smoking rooms are allowed in public transport facilities.
