Penalties or violators of any provisions regarding advertising and promotion could be subject a fine not exceeding five thousand Riyals (SAR 5,000). The fine is doubled in case of a repeated offense. However, the law does not specify which government body is responsible for enforcing provisions on advertising and promotion. The law only obliges public and private sector organizations to record violations and impose fines. There 31 is no clear duty to enforce the law.
To align with FCTC Art. 13 and the FCTC Art. 13 Guidelines, the law should specify the government entity authorized to enforce advertising and promotion provisions. In addition, the law should provide for other penalties in addition to fines, including corrective action and license suspension or cancellation for those involved in sponsorship activities.
