Definition
“Imitation tobacco product” means electronic or nonelectronic nicotine or non-nicotine delivery systems and other similar products that are made of materials other than tobacco product raw materials or physically-changed tobacco product raw materials and are intended for imitating tobacco product consumption.
Analysis
The definition of “imitation tobacco product” is significant because it encompasses e-cigarettes. The law prohibits the use, manufacture, import, sale, supply, display, and advertising of imitation tobacco products and their components.
For purposes of this review, we will use the term "e-cigarette" when referring to an electronic cigarette.
