Penalties
Manufacturer
Manufacturers and importers who violate packaging and labeling requirements are subject to a fine of not more than 20,000 baht.
The FCTC Art. 11 Guidelines state that Parties should specify a range of fines or other penalties commensurate with the severity of the violation and whether it is a repeat violation. To align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the drafters of the law should consider imposing higher penalties on manufacturers, importers, and wholesalers than on retailers, as those entities would be responsible for the more serious violation. In addition, the drafters should consider imposing higher penalties for repeat offenses, and additional or alternative penalties such as license suspension or revocation.
Importer
