The Tobacco Products Control Act of 2017 requires operators of smoke free areas or places to clearly mark those places/areas as smoke free zones. An operator who violates this provision is subject to a fine of not more than 50,000 baht.

The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines in that it provides for a fine for failure to post signs. To more fully align, the drafters of the law should consider imposing increased fines for repeat violations and additional or alternative penalties such as license suspension or revocation.

A person who smokes in a non-smoking place or area is subject to a fine of not more than 5,000 baht.

The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines in that it provides for a fine for smoking where prohibited.
