Analysis

The law provides a range of fines for various violations of the advertising and promotion provisions. Most advertising and promotion violations are subject to a fine ranging from 20,000 TL to 250,000 TL. For product placement provisions, local broadcasting institutions are subject to a fine from 1,000 TL up to 5,000 TL, regional broadcasting institutions from 5,000 TL up to 10,000 TL and national broadcasting institutions from 10,000 TL up to 50,000 TL. Violations of product display restrictions by retail establishments are subject to a fine from 1,000 TL up to 10,000 TL. Violations of provisions regarding candy and toys resembling tobacco products are subject to a fine from 20,000 TL up to 100,000 TL. Brand stretching on clothing, jewelry and accessories is a misdemeanor under the Misdemeanors Act.

Administrative fines shall be increased for the first and second repeat offenses taking place within the same year. In the case of a third subsequent offense within the same year, the business premises is to be closed for ten days to one month.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it provides for a range of fines commensurate with the seriousness of the violations.
