Disclosure by manufacturers and importers of cigarettes to government authorities of information on the contents and/or ingredients used in the manufacture of their cigarettes

Analysis

The law requires manufacturers, importers, suppliers, and distributors of tobacco or tobacco products to submit to the Tobacco Control Committee by January 30 of each year a report with the “contents specified in the Sixth Schedule to this Act” and other information as required by regulations. The Sixth Schedule requires, among other reports, a report on the "contents and emissions of the tobacco product."

The regulations provide additional reporting requirements for new products and changes or modifications to existing tobacco products. At least six months before introduction to the market, a manufacturer, importer, supplier, or distributor must submit a report that includes “the additives and ingredients of the tobacco product.”

The Committee can also require that reports be submitted upon request.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that it requires disclosure by manufacturers and importers to government authorities of information on the contents and/or ingredients used in the manufacture of their cigarettes. However, the law should further specify what is meant by “contents and emissions of the tobacco product.”

Analysis

The law requires disclosed information to be made publicly available and the Secretariat of the Tobacco Control Committee is required to "make the information from the reports readily accessible to the public in a timely manner."

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that it requires that disclosed information be made readily available to the public.
