Analysis
The Tobacco Control Act authorizes Public health officers under the Public Health Act and environmental inspectors appointed or designated by the National Environment Management Authority (NEMA) to enforce public smoking restrictions. The Minister of Health may issue regulations regarding a protocol for inspection and enforcement. As of the date of this review, regulations have not been issued.
To more fully align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the future regulations should make clear that the Act imposes a duty to enforce in its inspection and enforcement protocol.
