Tobacco Sponsorship
“Sponsorship of tobacco products and tobacco substitutes” means any action aimed at any activity or event or person, which aims to directly or indirectly promote the sale or use of tobacco products or substitutes for tobacco products with real or possible results.
The definition of "sponsorship of tobacco products and tobacco substitutes" contained in the law aligns with the definition of “tobacco sponsorship” provided in FCTC Art. 1(g).
Any form of contribution to any event, activity, or individual with the aim, effect or likely effect of promoting a tobacco product or tobacco use directly or indirectly. (FCTC Art. 1(g))
Tobacco Advertising and Promotion
“Advertising” means the spread of information — among indefinite number of people, through a variety of information media — on legal entities or natural persons, goods, ideas, or initiatives, intended to form or maintain interest in those natural persons and legal entities, goods, or initiatives.
“Promotion of consumption (sales) of tobacco products and tobacco substitutes” means any action, not containing advertising elements, defined as such by the law, may indirectly impact or impacts the increase of consumption of tobacco products and tobacco substitutes or indirectly raises the interest toward tobacco products and tobacco substitutes.
The law does not contain a definition of “tobacco advertising and promotion.” Instead, the Law on Advertising contains a general definition of “advertising” and the tobacco control law contains a definition of “promotion of tobacco products." Taken together, these definitions align with the definition of “tobacco advertising and promotion” provided in FCTC Art. 1(c).
Any form of commercial communication, recommendation, or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly. (FCTC Art. 1(c))
Tobacco Product
“Tobacco products” means any product, which is completely or partly produced from raw tobacco leaves or contains raw tobacco and produced in the way to be used for smoking or absorbing or chewing or breathing into the organism, including for breathing in by producing aerosol as a result of heating tobacco raw materials.
The definition of “tobacco products” contained in the law aligns with the definition of “tobacco product” provided in FCTC Art. 1.
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
