Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The law prohibits smoking in indoor workplaces except for airports and residential psychiatric care facilities, which are permitted to have designated smoking areas.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor workplaces.
All indoor public places
The law prohibits smoking in indoor public places except for airports and residential psychiatric care facilities, which are permitted to have designated smoking areas.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor public places.
All public transport
The law prohibits smoking in public transport except for water and rail transport, which are permitted to have designated smoking areas.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking on all forms of public transport.
Government facilities
The law prohibits smoking in state and local government facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to government facilities.
Private offices
The law prohibits smoking in “closed working areas” and “closed public areas.” Therefore, smoking in private offices is prohibited.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in private offices.
Hospitals
The law prohibits smoking in healthcare facilities and within 10 meters of the entrance. This includes hospitals.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to hospitals.
Residential healthcare facilities - public areas
The law prohibits smoking in healthcare facilities and within 10 meters of the entrance. This includes public areas of most residential healthcare facilities. However, the law makes an exception for residential psychiatric care facilities, which may have designated smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of all types of residential healthcare facilities.
Non-residential healthcare facilities
The law prohibits smoking in healthcare facilities and within 10 meters of the entrance. This includes non-residential healthcare facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to non-residential healthcare facilities.
Childcare facilities/preschools
The law prohibits smoking in, and within 10 meters of, preschools. The law also prohibits smoking within “other closed working areas” and “any other closed public area.” Therefore, smoking is prohibited in childcare facilities and preschools.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to childcare facilities and preschools.
Primary and secondary schools
The law prohibits smoking in, and within 10 meters of, the premises of preschool, general education, pre-vocational and secondary vocational, higher, and post-secondary educational institutions.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to primary and secondary schools.
Universities/vocational facilities
The law prohibits smoking in, and within 10 meters of, the premises of preschool, general education, pre-vocational and secondary vocational, higher, and post-secondary educational institutions.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to universities and vocational facilities.
Shops
The law prohibits smoking in “closed working areas,” “trade centers,” and “closed public areas.” Therefore, smoking is prohibited in shops.

Cultural facilities
The law prohibits smoking in the areas of immovable cultural and historical monuments, as well as in “other closed working areas” and “other closed public areas.” Therefore, smoking is prohibited in all cultural facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to cultural facilities.
Indoor stadium/arenas
The law prohibits smoking in “closed working areas” and “closed public areas.” This includes indoor stadiums and arenas. Therefore, the law is interpreted as prohibiting smoking in all indoor stadiums/arena.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to indoor stadiums/arenas.
Restaurants
The law prohibits smoking in “public caterings facilities, including outdoor areas (canteens, restaurants, cafes, bars, buffets and other cooking and selling facilities).”

Bars/pubs/nightclubs
The law prohibits smoking in “public caterings facilities, including outdoor areas (canteens, restaurants, cafes, bars, buffets and other cooking and selling facilities).”
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to bars, pubs, and nightclubs.
Casinos
The law prohibits smoking in “closed working areas” and “closed public areas.” Therefore, the law is interpreted as prohibiting smoking in casinos.

Hotels/lodging - public areas
The law prohibits smoking in “hotel facilities (resorts, resort and specialized camps or houses, boarding houses, resort, youth and camping complexes, holiday homes).”

Hotels/lodgings - guest rooms
The law prohibits smoking in “hotel facilities (resorts, resort and specialized camps or houses, boarding houses, resort, youth and camping complexes, holiday homes).” There are no exceptions. Therefore, the law is interpreted as prohibiting smoking in guest rooms in hotels.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to guest rooms in hotels and lodging facilities.
Prisons/detention facilities - public areas
The law prohibits smoking in “closed working areas” and “closed public areas.” Therefore, the law is interpreted as prohibiting smoking in public areas of prisons and detention facilities. However, other areas of prisons and detention facilities are governed by the justice and health authorities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to smoking in public areas of prisons/detention facilities.
Trains, buses and other shared ground transportation other than taxis
The law prohibits smoking in “in general use vehicles, in light passenger-taxi cars, airplanes, overland electric transport, and underground transport. However, the law allows water and railway transport to have designated smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking on trains, as well as in buses and other shared ground transport.
Taxis (for-hire vehicle)
The law prohibits smoking in taxis.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to taxis.
Commercial aircraft
The law prohibits smoking in air transport.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to commercial aircraft.
Commercial watercraft
The law permits smoking in designated smoking areas of water transport.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all part of commercial watercraft.
Public transport facilities (waiting areas for mass transit)
The law prohibits smoking under covered public transport stops, except for in airports, where smoking is allowed in designated smoking areas.

Youth Sport Organizations
Smoking is prohibited in, and within five meters of the entrance of, youth sport organizations.
Private Vehicles
The law prohibits smoking in a moving private vehicle. The law does not prohibit smoking in non-moving or parked private vehicles. Therefore, smoking is restricted in private vehicles.
