Law on Reduction and Prevention of the Damage Caused by the Use of Tobacco Products and Substitutions for Them:
“Imitations of tobacco products” means products, not containing raw tobacco and working electronically (electricity or batteries) with cartridge or container, by means of which the aerosol, resulted from the evaporation of solution or mixture, containing nicotine and propylene glycol or glycerine and in some cases flavor or odor supplements, is passed to the organism of the user.
Decision No. 155 on Approving the Technical Regulations:
“Nicotine-containing products (NCP)” means a product intended for use by the consumer by inhalation of an aerosol containing nicotine or nicotine salts generated during the operation of the [nicotine delivery system].
For the purpose of this review, we will use the term “e-cigarettes” when referring to “imitations of tobacco products” (under the Tobacco Control Law) and “nicotine-containing products” (under Decision No. 155).
The use of tobacco product or tobacco substitute
“The use of tobacco product or tobacco substitute” means the application of the tobacco product or tobacco substitute by smoking or inhaling or chewing or breathing in or out of organism.
The definition of “the use of tobacco product or tobacco substitute” is significant because it includes the use of e-cigarettes, which are defined under the law as tobacco substitutes.
Nicotine delivery system
“Nicotine delivery system (NDS)” means a device necessary for the use of a [nicotine-containing product] (including an electronic vaporizer, a device for heating an electronic vapor generator, etc.), which is necessary to obtain an aerosol inhaled by the consumer from the filler (the NDS can be structurally connected with [nicotine-containing products]).
