Health Warnings/Messages Features
Smoked tobacco products must carry a general warning (“Smoking Kills”), an informational message ("Tobacco smoke contains over 70 carcinogenic substances"), and one of the fourteen combined text/picture health warnings detailed in Appendix 1 and 2 of Order 669 of 2016.
For cigarette and rolling tobacco in box shaped packages, the general warning must cover 50% of the bottom portion of one of the lateral sides of the packet. The informational warning must cover 50% of the bottom portion of the other later side of the packet. Both the general warning and informational warning must be at least 20mm in width.
For packages that have a hinged lid and flap, which causes the side area to split when the package is open, the general and information warnings must be placed in their entirety on the largest of the two areas. Further, the general warning must be carried inside of the upper area of the package that is visible when the package is open. The law also provides additional requirements for general and information warnings on rolling tobacco in cylindrical packets, rectangular pouches, and standing pouches.
The combined health warnings must cover 65% of both the front and back of the package. Combined health warnings are divided into three sets, and each set shall be used in a given year and replaced by the next set the following year. The combined health warning must include quitting information: “Stop Line: 80 31 31 31 www.stoplinien.dk.”
Smoking products other than cigarettes, rolling tobacco and hookah tobacco, must contain the general warning that covers 30% of the most visible surface of the packaging.
The law meets FCTC Art. 11 and aligns with the FCTC Art. 11 Guidelines with respect to size, location, and rotation of health warnings on packages of smoked tobacco products.
The sale of tobacco products for oral use (e.g., snus) is prohibited. For other smokeless tobacco products, a general warning - "This tobacco product is harmful to your health and is addictive" - must cover 30% of the front and back of the package.
The law meets the minimum requirements of FCTC Art. 11 in that the text warning must occupy at least 30% of the surface of the package.
However, to fully align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the law should require warnings be composed of pictures and text, include a variety of messages to be displayed at any given time, and require that the warnings rotate on a regular basis. In addition, the law should expressly require the warnings to appear on at least 50% of each principal display area.
