Tobacco Product
Tobacco/Tobacco product: Product made wholly or partly from tobacco plants, such as cigarettes, cigars, smoking tobacco (pipe tobacco), snuff and chewing tobacco.
Tobacco: Tobacco plants (nicotiana) and all products made entirely or in part from them for consumption, such as cigarettes, cigars, smoking tobacco, nasal tobacco and oral tobacco.
The Act and the Regulations each contain a definition of “tobacco,” which vary slightly but are substantively the same. Both definitions align with the definition of “tobacco product” contained in FCTC Art. 1(f).
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
Outside Packaging and Labeling
Outside packaging: Any packaging in which tobacco or related products are placed on the market, including unit packets and an aggregation of unit packets. Transparent wrappers are not regarded as outside packaging.
The definition of "outside packaging” contained in the law aligns with the definition of “outside packaging and labeling” provided in FCTC Art. 11.
Any packaging and labeling used in the retail sale of the product. (FCTC Art. 11(4))
Oral Tobacco
Oral tobacco within the meaning of this Act shall refer to all products made entirely or partly from tobacco, for oral use, except those intended for smoking.
The definition of “oral tobacco” is significant because the Tobacco Control Act prohibits “the importation, manufacture and sale of fine-grained snuff and all oral tobacco, with the exception of chewing tobacco.”
Chewing Tobacco
Chewing tobacco within the meaning of this Act shall refer to oral tobacco in pieces or strips, mainly intended for chewing.
The definition of “chewing tobacco” is significant because the Tobacco Control Act prohibits “the importation, manufacture and sale of fine-grained snuff and all oral tobacco, with the exception of chewing tobacco.”
Snuff
Snuff within the meaning of this Act shall refer to powder or grains, made entirely or partly from tobacco, for nasal use.
The definition of “snuff” is significant because the Tobacco Control Act prohibits “the importation, manufacture and sale of fine-grained snuff and all oral tobacco, with the exception of chewing tobacco.”
Smokeless Tobacco
Smokeless tobacco: Tobacco products not intended for smoking.
The definition of “smokeless tobacco” is significant because the regulations contain a required warning for “smokeless tobacco.”
