Analysis

Violations of packaging and labeling provisions are punishable by fines or imprisonment of up to two years, irrespective of whether they are committed on purpose or through negligence. Fines imposed on natural persons may range from ISK 10,000–10,000,000. Fines imposed on legal persons may range from ISK 25,000–25,000,000. Profits, direct or indirect, resulting from violations of packaging and labeling provisions may be confiscated by a court order. ATVR may confiscate and destroy tobacco products that do not meet packaging and labeling requirements.

In addition, if a manufacturer fails to comply with corrective instructions from ATVR, ATVR may impose per diem fines on it until the situation is rectified. The fines may amount to as much as ISK 500,000 per day.

Analysis

If a retailer violates packaging and labeling provisions, the local authority board of health may, after issuing a reprimand, revoke the permit. In the case of repeated violations, or gross violation, the board of health must revoke the permit.

ATVR may impose fines on natural persons in the range of ISK 10,000–10,000,000 and on legal persons in the range of ISK 25,000–25,000,000. Violators may also be subject to up to two years in prison. Profits, direct or indirect, resulting from violations of packaging and labeling provisions may be confiscated by a court order.
