Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The law restricts smoking in most indoor workplaces to authorized smoking areas. However, the law prohibits smoking in some enumerated workplaces, including but not limited to entertainment and public services areas, gas stations and other places that create or maintain flammable substances, public lounges of hotels, designated hotel rooms, kindergartens, all levels of school, school dormitories, hospitals, health resorts, and lobbies.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of all indoor workplaces.
All indoor public places
The law restricts smoking in most indoor public places to authorized smoking areas. However, the law prohibits smoking in some enumerated public places, including but not limited to entertainment and public services areas, gas stations and other places that create or maintain flammable substances, public lounges of hotels, designated hotel rooms, kindergartens, all levels of school, school dormitories, hospitals, health resorts, lobbies, stairs, elevators in apartment buildings, playgrounds, and parks.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should not provide exceptions to the prohibition of smoking in indoor public places.
All public transport
The law prohibits smoking in all public transport vehicles, including trains and airplanes, and inside public transport facilities.

Government facilities
The law restricts smoking in indoor workplaces to authorized smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all areas of all government facilities.
Private offices
The law restricts smoking in indoor workplaces to authorized smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all areas of private offices.
Hospitals
The law prohibits smoking in hospitals.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all hospital areas.
Residential healthcare facilities - public areas
The law prohibits smoking in health resorts, which is interpreted to include residential healthcare facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to public areas of residential healthcare facilities.
Non-residential healthcare facilities
The law restricts smoking in indoor workplaces to authorized smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all non-residential healthcare facilities.
Childcare facilities/preschools
The law prohibits smoking in kindergartens and in all levels of school, and this is interpreted as prohibiting smoking in childcare facilities/preschools. Therefore, the regulatory status code “100% Smoke Free” is given.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to childcare facilities/preschools.
Primary and secondary schools
The law prohibits smoking in all levels of school.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to primary and secondary schools.
Universities/vocational facilities
The law prohibits smoking in all levels of school and in school dormitories.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to universities/vocational facilities.
Shops
The law restricts smoking in shopping centers to authorized smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of shops.
Cultural facilities
The law prohibits smoking in all entertainment areas.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to cultural facilities.
Indoor stadium/arenas
The law prohibits smoking in entertainment areas, and this is interpreted to include indoor stadiums or arenas. Therefore, the regulatory status code “100% Smoke Free” is given.

Restaurants
The law restricts smoking in restaurants to authorized smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of all restaurants.
Bars/pubs/nightclubs
The law restricts smoking in bars to authorized smoking areas. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of all bars, pubs and nightclubs.
Casinos
Casinos are illegal in Mongolia.
Hotels/lodging - public areas
The law prohibits smoking in public lounges of hotels.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to public areas of hotels or lodging.
Hotels/lodgings - guest rooms
The law restricts smoking in hotel guest rooms to rooms that are specifically designated as smoking rooms. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of all guest rooms of hotels/lodging.
Prisons/detention facilities - public areas
The law does not specifically address smoking in public areas of prisons/detention facilities. However, the law generally restricts smoking in indoor workplaces to authorized smoking areas. Because prisons and detentions facilities are workplaces, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in public areas of prisons/detention facilities.
Trains, buses and other shared ground transportation other than taxis
The law prohibits smoking in all public transport vehicles, including trains.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to trains, buses, and other shared ground transportation.
Taxis (for-hire vehicle)
The law prohibits smoking in all public transport vehicles, and this is interpreted as including taxis.

Commercial aircraft
The law prohibits smoking in airplanes.

Gasoline stations, factories, and facilities for the manufacturing of flammable and explosive substances and machine oil
The law prohibits smoking in gasoline stations, factories, and facilities for the manufacture of flammable and explosive substances and machine oil, as well as their storage areas. Therefore, the regulatory status code “100% Smoke Free” is given.
Lobbies, stairs, and elevators in apartment buildings
The law prohibits smoking in lobbies, stairs, and elevators in apartment buildings.
