Enforcement Authorities
Police or any other law enforcement agency of government
The National Tobacco Control Act states that “the police or any other law enforcement agency of government shall have the duty to inspect and investigate complaints and take appropriate enforcement action under the Act and in regulations made under the Act.” The police are authorized to enter any public place, workplace or public transport to conduct inspections. The National Tobacco Control Regulations provides for a list of specified authorized officers and responsible persons as well as powers granted for inspection.
The law aligns with the FCTC Art. 8 and the FCTC Art. 8 Guidelines in that it identifies the enforcement agencies and officers as well as specifying inspection and enforcement powers.
