For the purpose of this review, we will be using the term “HTP” when referring to a “heated tobacco product.”
Electronic hookah or electronic cigarette
“Electronic hookah or electronic cigarette” means equipment that uses electrical energy to create water vapor having characteristics similar to tobacco smoke, however that vapor may be generated, and inhaled in a manner similar to the inhalation of tobacco smoke.
The definition of “electronic hookah or electronic cigarette” is considered by regulators to encompass HTP devices.
This definition is significant because the law bans the sale and import of e-cigarettes, which includes HTP devices as they are “equipment that uses electrical energy to create water vapor having characteristics similar to tobacco smoke…and inhaled in a manner similar to the inhalation of tobacco smoke.”
Liquid for filling hookahs or electronic hookahs or electronic cigarettes
“Liquid for filling hookahs or electronic hookahs or electronic cigarettes” means any chemical element, chemical compound, or other material of any derivation that is used as a source for smoke, water vapor, or other vapor in a hookah, electronic hookah, or electronic cigarette. This term shall further include vegetable matter, fruit, preserved vegetable matter, or preserved fruit used as a source for smoke, water vapor, or other vapor in a hookah, electronic hookah, or electronic cigarette.
The definition of “liquid for filling hookahs or electronic hookahs or electronic cigarettes” is considered by regulators to encompass tobacco inserts.
This definition is significant because the law bans the sale and import of the liquid for filling e-cigarettes, which includes tobacco inserts because they are a “chemical compound…used as a source for smoke or other vapor… in a[n] electronic cigarette.”
