The Code on Administrative Responsibility imposes a fine of 50 to 100 times the base calculation unit (BCU) for violations of provisions on production or circulation of tobacco products, which includes packing and labeling provisions.
To align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the penalty provisions should specify a range of fines and penalties commensurate with the severity of the violation and whether it is a repeat violation. In addition, the law should consider other penalties such as license suspension and/or revocation.
