E-Cigarette
“Electronic cigarette” means a product that can be used for the consumption of nicotine-containing vapor through a mouthpiece, or a component of that product, including a cartridge, a reservoir and the device without a cartridge or reservoir.
For the purpose of this review, we will be using the term “e-cigarette” when referring to an “electronic cigarette.”
Electronic vapor goods
“Electronic vapor goods” means electronic cigarette, refill pack, electronic cigarette without nicotine, refill pack without nicotine and cartridge without nicotine.
The definition of electronic vapor good is significant because it includes e-cigarettes.
Related product
“Related product” means electronic vapor merchandise, electronic heating device and herbal product intended for smoking.
The definition of “related product” is significant because it includes e-vapor goods, which includes e-cigarettes. These “related products” are regulated under the Act.
Advertising
“Advertising” means any action in the economic sphere designed to promote the sale of tobacco products and related products and any form of commercial communication whose purpose or effect is, directly or indirectly, to publicize or promote a tobacco product or related product, including advertising which, without directly mentioning the tobacco product or related product, attempts to circumvent the advertising ban by using a name, trademark, symbol or any other distinctive sign of a tobacco product or related product.
The definition of “advertising” is significant because it encompasses advertising of tobacco and “related products”, which includes e-cigarettes. Therefore, the ban on advertising applies to e-cigarettes.
Sponsorship
“Sponsorship” means any public or private economic contribution to an activity, event or person, the purpose or direct or indirect effect of which is to publicize or promote a tobacco or related product.
The definition of “sponsorship” is significant because it encompasses sponsorship of tobacco and “related products”, which includes e-cigarettes. Therefore, the ban on sponsorship applies to e-cigarettes.
Smoking ban
“Smoking ban” means the prohibition of smoking tobacco products, consuming tobacco products other than by smoking, or consuming the vapor of electronic cigarettes or electronic cigarettes without nicotine.
The definition of “smoking ban” is significant because it includes a ban on smoking e-cigarettes.
