E-cigarettes are primarily regulated under the Tobacco Act. However, the provisions of the Tobacco Act do not apply to an e-cigarette or refill packaging for which a marketing authorization is required pursuant to Section 40, paragraph 1, of the Medicines Act or an e-cigarette for which a CE mark is required pursuant to Section 7 of the Medical Devices Decree.
