Sales Restrictions
Sale of single cigarettes/sticks
The law prohibits the sale of single cigarette sticks.
The law aligns with FCTC Art. 16 in that the law prohibits the sale of single cigarettes.
Sale of tobacco products via vending machines
The law prohibits vending machine sales of tobacco products.
The law aligns with FCTC Art. 13, the FCTC Art. 13 Guidelines, and FCTC Art. 16 in this respect.
Sale of tobacco products via the internet
Sale of smokeless tobacco products
The law prohibits the manufacture, import and sale of “oral tobacco.” “Oral tobacco” is defined as “all oral tobacco products, other than those intended for inhalation or chewing.” Therefore, the sale of some smokeless tobacco products is banned, and the code “Some Restrictions” is given.
Sale of waterpipe tobacco products
The law does not specifically prohibit the sale of waterpipe tobacco; therefore, the law is interpreted as permitting the sale of waterpipe tobacco.
Location-based Sales Restrictions
Schools/educational facilities
The law prohibits the sale of tobacco products in the premises and on the territory of educational institutions.
Playgrounds
The law prohibits the sale of tobacco products in “places of sports competition with the participation of children”. This potentially could be interpreted as prohibiting the sale of tobacco products on playgrounds. However, not all playgrounds host sports competitions. Therefore, the regulatory status “uncertain” is given.
Stadiums/arenas
The law prohibits the sale of tobacco products in indoor sports facilities. Because the sale of tobacco products is not prohibited in outdoor sports facilities, the regulatory status code "Some Restrictions" is given.
Healthcare facilities
The law prohibits the sale of tobacco products in the premises and on the territory of health care facilities, "except for restaurants that are located on the premises of sanatoriums." Due to this exception, the regulatory status "Some Restrictions" is given.
Cultural facilities
The law does not prohibit or restrict the sale of tobacco products in cultural facilities; therefore, the law is interpreted as permitting the sale of tobacco products in cultural facilities.
On the premises of specialized trade organizations that conduct trade in children’s goods or sporting goods and in the respective departments (sections) of global trade organizations
The law prohibits the sale of tobacco products on the premises of specialized trade organizations that conduct trade in children's goods or sporting goods, and also in the respective departments (sections) of global trade organizations.
In places of sports competition with the participation of children
The law prohibits the sale of tobacco products in “places of sports competition with the participation of children”.
Direct sales, sales from stalls (kiosks)
The prohibits the direct sale of tobacco products and sales from stalls (kiosks).
Retail Package Size Restrictions
Minimum number of cigarette sticks per unit package
The law prohibits the sale of cigarettes in packages of less than 20 sticks.
The law aligns with FCTC Art. 16 with respect to the sale of small packets of cigarettes.
Roll your own cigarette tobacco
Currently, the law does not regulate the minimum weight of an individual pack of tobacco for roll-your-own cigarettes. In January 2024, when Law 1978-IX comes into effect, amending Law No. 2889-IV (Art. 12), the law will prohibit the sale of roll-your-own tobacco in pack of less than 30 grams |
Minimum weight of smokeless tobacco per unit package
The law does not require a minimum weight per unit package of smokeless tobacco.
Retail Licensing Requirements
Specific retail license or equivalent approval required to sell tobacco products
The law requires retail traders in tobacco products to obtain a tobacco product trading license.
The law aligns with FCTC Art. 15 in that the law requires retailers to obtain a license or equivalent approval to sell tobacco products.
