Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
Smoking is prohibited in nearly all workplaces, including, for example, restaurants, educational facilities, and health facilities. However, designated smoking rooms with ventilation are required in airports, which may not exceed 5% of the total area of the airport.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should require all parts of all indoor public places and workplaces to be 100% smoke free.
All indoor public places
Smoking is prohibited in nearly all public places, including, for example, restaurants, educational facilities, and health facilities. However, designated smoking rooms with ventilation are required in airports, which may not exceed 5% of the total area of the airport.

Smoking is prohibited in all public transport.

Government facilities
Smoking is prohibited in state agencies, local self-government agencies, and other state establishments.

Private offices
Smoking is prohibited in all parts of premises of enterprises, establishments and organizations of all forms of ownership. Designated smoking areas are not allowed.

Hospitals
The law prohibits smoking “on the premises and on the territory of health care institutions”, which includes hospitals.

Residential healthcare facilities - public areas
The law prohibits smoking “on the premises and on the territory of health care institutions”, which includes public areas of residential health care facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with regard to public areas of residential healthcare facilities.
Non-residential healthcare facilities
The law prohibits smoking “on the premises and on the territory of health care institutions”, which includes non-residential health care facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with regard to non-residential healthcare facilities.
Childcare facilities/preschools
The law prohibits smoking in educational and child-rearing institutions. Therefore, preschools and childcare facilities are 100% smoke free.

Primary and secondary schools
The law prohibits smoking in “educational institutions,” which includes primary and secondary schools.

Universities/vocational facilities
The law prohibits smoking in “educational institutions,” which includes universities, vocational facilities and dormitories.

Shops
Smoking is prohibited in the premises of enterprises, institutions and organizations of all forms of ownership,” including shops.

Cultural facilities
Smoking is prohibited in cultural facilities.

Indoor stadium/arenas
Smoking is prohibited in indoor sports and physical health facilities and physical education and sports institutions.

Restaurants
Smoking is prohibited in public dining institutions, which includes restaurants.

Bars/pubs/nightclubs
Smoking is prohibited in public dining institutions, which includes bars, pubs, and nightclubs.

Casinos
Smoking is prohibited “on the premises of enterprises, institutions and organizations of all forms of ownership,” including casinos.

Hotels/lodging - public areas
Smoking is prohibited in the “premises of hotels and similar accommodation facilities,” including public areas.

Hotels/lodgings - guest rooms
Smoking is prohibited in the “premises of hotels and similar accommodation facilities.” The definition of premises is “any space having a roof and bounded by two or more walls or partitions, regardless of the material of roof, walls or partitions and regardless of whether the structure is permanent or temporary.” Therefore, the ”premises of hotels” includes guestrooms, and guestrooms must be smokefree.

Prisons/detention facilities - public areas
Smoking is prohibited “in the premises of state agencies and local self-government agencies, [and] other state establishments”, with no designated smoking areas allowed. Therefore, smoking will be banned in public prisons, including public areas.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to public areas of prisons.
Trains, buses and other shared ground transportation other than taxis
Smoking is prohibited in public transport, which includes trains, buses, and other shared ground transportation.

Taxis (for-hire vehicle)
Smoking is prohibited in taxis.

Commercial aircraft
Smoking is prohibited in public transport. This is interpreted as including commercial aircraft.

Commercial watercraft
Smoking is prohibited in public transport. This is interpreted as including commercial watercraft used for public transport.

Public transport facilities (waiting areas for mass transit)
Smoking is prohibited in train stations and the smoking areas in airports are limited to 5% of the total area of the airport. Smoking is prohibited at other “transportation stops.”
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should require all parts of all indoor public places and workplaces, including all public transport facilities, to be 100% smoke free.
Elevators
The law designates elevators as smoke free.
Public payphones
The law prohibits smoking in public payphones.
Underground (pedestrian) passages
The law prohibits smoking in underground subway (pedestrian) passages.
Entrances to residential buildings
The law prohibits smoking in the entrances and all “places of common use of residential buildings.”
