Tobacco Sponsorship
The law does not contain a definition of "tobacco sponsorship." Undefined key terms or ambiguous definitions can undermine the application of other substantive provisions of a law.
A definition of “tobacco sponsorship” should be provided in accordance with the definition provided in FCTC Art.1(g).
Any form of contribution to any event, activity, or individual with the aim, effect or likely effect of promoting a tobacco product or tobacco use directly or indirectly. (FCTC Art. 1(g))
Tobacco Advertising and Promotion
The law contains a definition for “advertise”; however, this definition specifically relates to electronic smoking devices. Therefore, the law does not contain a definition of advertising that includes tobacco products. Undefined key terms or ambiguous definitions can undermine the application of other substantive provisions of a law.
A definition of “tobacco advertising and promotion” should be provided in accordance with the definition provided in FCTC Art. 1(c).
Any form of commercial communication, recommendation, or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly. (FCTC Art. 1(c))
Tobacco Product
“Tobacco product” means products entirely or partly made from tobacco leaves which are manufactured to be used for smoking, sucking, chewing or snuffing.
The definition of "tobacco product" contained in the law aligns with the definition of “tobacco product” provided in FCTC Art. 1(f).
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
Minor
"Minor" means a person under the age of 18 years.
The definition of “minor” is significant because the law prohibits advertising and promotion of the use of tobacco products by minors.
Automatic Sales Machine
"Automatic sales machine" means a machine or device from which products can be obtained by an operation which involves the activation by insertion of money or token.
The definition of “automatic sales machine” is significant because the term is used to describe vending machines, and the law limits the sale of tobacco products through these machines.
